Terms of Service & Engagement
Last Updated: September 2026 • Governing Standards: Commercial Practice & Cross-Border Service Agreements
1. Nature of Engagement & Regulatory Boundaries
MCR Associates provides dedicated remote technical, administrative, and back-office operational capacity directly to Australian registered Tax Agents, BAS Agents, accounting and taxation firms, AFSL wealth advisory licensees, authorised insurance brokerages, Australian Credit Licence (ACL) holders, and financial services businesses across 4 core verticals: Financial Advisory Back-Office, Accounting & Tax Back-Office, Insurance Broker Back-Office, and Mortgage & Finance Broking Back-Office.
MCR Associates operates strictly as a B2B back-office delivery engine and does not provide direct consumer financial product advice, retail tax advice, insurance placement authority, credit assistance (under the NCCP Act 2009), or legal services. Under TASA 2009, Corporations Act 2001, NCCP Act 2009, and relevant Australian statutory frameworks, the Australian supervising principal, AFSL responsible manager, Australian Credit Licensee, or registered practitioner remains the sole authority responsible for final client sign-off, advisory authority, credit assistance decisions, and statutory lodgments.
2. 10-Day Paid Proof-of-Concept Pilot
MCR Associates offers a structured 10-Day Paid Pilot across any operational vertical (e.g., 1 Simple/Standard SOA or Standalone ROA in Xplan/Plutosoft, 2 Live Overflow Tax Returns, 1 SMSF Pre-Audit Pack, a 10-day Insurance Policy Admin, Document Indexing & Claims Sprint, or a Mortgage Loan File Packaging & Living Expense Audit Sprint).
- Pilots are billed transparently according to our published rates or deliverable fee card with zero setup fees.
- All pilot deliverables undergo two-tier review by a Senior Lead prior to dispatch.
- The pilot carries zero ongoing lock-in commitment. Following completion, client firms and businesses may choose to transition to a monthly capacity retainer or conclude the engagement without penalty.
3. Month-to-Month Rolling Agreements & 50% Rollover Policy
All recurring monthly retainer plans (part-time, full-time, or dedicated pods) operate on a flexible rolling month-to-month agreement:
- Flexible Adjustment: Firms and businesses may scale allocated hours up or down, or cancel services, by providing 14 days' written notice prior to the next billing cycle. There are zero exit penalties.
- 50% Hours Rollover: Unused retainer hours in any billing cycle may roll over up to a maximum of 50% of unused hours into the next consecutive calendar month only. Rolled-over hours expire at the end of that subsequent month and do not accumulate further.
4. 100% Client Intellectual Property (IP) Ownership
The Australian client firm retains 100% unencumbered ownership of all client workpapers, tax schedules, Statement of Advice models, strategy templates, software scripts, and deliverables produced during the engagement upon payment of agreed fees. MCR Associates asserts zero proprietary claim over client work product.
5. Binding Non-Solicitation Covenant
MCR Associates warrants and covenants never to solicit, contract directly with, or provide direct retail accounting, taxation, financial advisory, or insurance services to any end-client of our partner firms. This non-solicitation obligation is legally binding and survives termination of any service agreement for a period of not less than twenty-four (24) months.
6. Invoicing, Currency & Payment Terms
Invoices are issued in Australian Dollars (AUD) or US Dollars (USD) as agreed, payable within 7 business days via direct electronic funds transfer (EFT) or secure payment gateway. Retainers are billed at the beginning of each monthly service cycle.
